The Supreme Court of Justice issued a favorable opinion for the extradition of alias ‘Chiquito Malo’, requested by the United States authorities for his alleged participation in international drug trafficking as a high-ranking member of the Clan del Golfo, one of the most powerful criminal organizations in the country.

According to the formal request presented by Washington, the requested person would have played a strategic role within the criminal structure, coordinating for more than a decade the shipment of large shipments of cocaine from the northern coast of Colombia to Central America, Mexico and the United States.

For these operations, the organization used speed boats and maritime containers, according to the indictment.

The US authorities maintain that alias ‘Chiquito Malo’ would have received payments in dollars as a result of the marketing of the drug, which reinforces his alleged responsibility within the transnational drug trafficking network.

In its analysis, the Criminal Cassation Chamber concluded that all constitutional and legal requirements to grant extradition are met.

The Court also noted that, although alias ‘Chiquito Malo’ registers multiple active criminal proceedings in Colombia, including investigations for homicide, forced displacement, extortion and use of minors, none has culminated in a final sentence that prevents his surrender to the United States justice system.

Another point addressed by the high court was the current situation of the person requested. The Court confirmed that he has not been captured by the Colombian authorities and that he is a fugitive, which is why it was not possible to carry out a direct fingerprint comparison. However, he considered that his identity is fully accredited based on the official documents sent by the authorities of both countries.

With this favorable concept, the final decision on the extradition of alias Chiquito Malo now remains in the hands of President Gustavo Petro, who must evaluate the Supreme Court’s ruling before authorizing or denying his delivery to the United States.
