The Attorney General’s Office advanced in the investigation into the serious accident that occurred on October 31 on José Celestino Mutis Avenue and Carrera 98, in the west of Bogotá, in which two motorcyclists immediately lost their lives.

Within the framework of the judicial process, Edwin Leonardo was identified as the person who allegedly had a determining role in the events.

According to the accusing body, Edwin would be the owner of the vehicle involved in the accident and would have allowed the car to be driven by a man who was intoxicated.

According to the reconstruction of the events, during the journey the driver lost control of the car, entered the opposite lane and ran over the two victims, who died at the scene.

The investigations carried out by the Prosecutor’s Office made it possible to establish that, minutes before the accident on Mutis Avenue, the defendant and the driver of the vehicle were sharing in an establishment dedicated to the sale of alcoholic beverages. Both would have remained at the site for about two hours before getting into the car.

“The evidentiary material shows that Mr. Delgado Comba was in the back seat of the vehicle and allegedly omitted his duty to prevent a person in a state of intoxication from driving the car, which would have directly contributed to the occurrence of the accident.”explained the Attorney General’s Office.

Based on these elements, a prosecutor from the Life Unit of the Bogotá Section charged Edwin Leonardo with the crime of intentional homicide in the form of commission by improper omission, a legal figure that is applied when a person, having the duty to act, abstains and allows a fatal result to occur.

Although the defendant did not accept the charges against him, he will continue to be linked to the criminal process while the corresponding judicial stages progress.

The case of the accident on Mutis Avenue continues to be analyzed by the authorities, in a process that seeks to establish responsibilities for the death of the two motorcyclists.
