The District Person’s Office of Medellín formulated a statement of charges against Juan Sebastián, a nursing assistant at the ESE Metrosalud, accused of having committed alleged abuse of a patient within the Belén Hospital Unit, where he was working shift on May 21, 2021.
According to the authorities, the victim was in a state of defenselessness and did not have the capacity to oppose or grant consent.
According to the disciplinary body, the person under investigation had committed a very serious offense by way of fraud. The case progressed after the victim, a 26-year-old woman, was admitted with symptoms of dizziness, headache and blurred vision. After being evaluated, she was administered medications that left her in a vulnerable condition, a situation that, apparently, the assistant took advantage of to transfer her to a resuscitation room and carry out the alleged sexual assault.

Yenny Teresita Serna, 20D delegate, explained that the conduct attributed to Álvarez Vergara “is classified as a crime according to article 207 of the Colombian Penal Code,” stressing that it was committed in a particularly delicate context, since the alleged aggressor was linked to a public health entity, which implies a higher ethical requirement for all officials.

The Ombudsman pointed out that the incident not only violates the dignity of the victim, but also violates essential principles of the profession, constituting a serious breach in the trust placed in the healthcare personnel.
The eighth Municipal Criminal Court of Medellín imposed a restraining order on the assistant in his place of residence, while the investigation for abuse of a patient unable to resist progresses.
