The defense of Ricardo, one of the alleged perpetrators of the murder of the Universidad de los Andes student, Jaime Moreno, presented at a hearing an appeal to revoke the security measure in the prison imposed by a guarantee control judge in Bogotá.

Ricardo, 23, is accused of participating in the brutal beating that caused the death of Jaime Moreno, 20, during the early hours of October 31.

In her defense before the second instance judge, lawyer Marcela López insisted on the thesis of a pre-intentional homicide, arguing that her client’s intention was only to injure the victim, not cause her death.

Furthermore, the defense attacked the first instance decision for not having specified the positive fact that demonstrated the existence of a prior agreement or co-authorship with Juan Carlos, the other person involved who was already sent to prison for the case.

Ricardo’s lawyer also questioned whether the history of work problems due to alcohol consumption was used as a justification to classify her client as a future danger to society.

For their part, the Prosecutor’s Office, the Attorney General’s Office and the representation of the victims asked the second instance judge to maintain the security measure, considering him a danger to society and justifying it with the extensive evidentiary material that demonstrates the participation of this subject in the lethal attack.

The sixth guarantee control judge who initially imposed prison on Ricardo argued that “Whoever kicks the head of a human being cannot claim that he did not foresee the fatal result” and that the case was not a minor quarrel, but a “lethal aggression from the first moment.”

Now, the distribution and assignment is pending so that a second instance judge can make the final decision on whether Ricardo will continue in jail while the judicial process in the Jaime Moreno case progresses.
