In an unprecedented event that worsens the crisis in the sector, the organization Pacientes Colombia, which brings together 202 user associations, filed a criminal complaint with the Attorney General’s Office against the Minister of Health, Guillermo Alfonso Jaramillo.

The judicial action is based on alleged fraud of a judicial resolution, arguing that the official has “consciously and repeatedly” failed to comply with multiple orders of the Constitutional Court aimed at guaranteeing the financial sufficiency of the system.

According to the complainants, this administrative omission has generated instability that puts the fundamental right to health of millions of Colombians at risk.

The complaint maintains that Jaramillo ignored historical rulings, such as Ruling T-760 of 2008, by not correctly adjusting the Capitation Payment Unit (UPC) based on technical studies and not only on inflation.

In addition, it is questioned for late and insufficient payments in the maximum budgets, which has led to financial instability for the lending entities.

Patients Colombia also warned that the technical tables ordered by the high court have been used as a “formal mechanism” without real deliberation, where key actors were excluded and essential technical information was hidden.

This strong legal movement is known just days after the death of the child Kevin Acosta, a case that became the face of the instability of the system after the failure to deliver medications for hemophilia.

While Minister Jaramillo insists that the system “is paying on time” and attributes tragedies like Kevin’s to the lack of prevention in physical activities, patient organizations request urgent precautionary measures, including the temporary suspension of the minister’s functions related to the transfer of resources, to prevent defunding from continuing to claim lives in the country.
