The Attorney General’s Office presented a report before the Administrative Court of Cundinamarca within the framework of a compliance action, in which it requests to order the immediate payment of electricity and natural gas subsidies already recognized by administrative acts and supported with resources in the General Budget of the Nation.
The report details the serious non-compliance in the payment of electricity and natural gas subsidies to marketing companies, which has generated a critical financial situation for companies in the sector, with the risk of an increase in rates of up to 150%, or even the suspension of the service.
Likewise, the control entity ruled against the supervening evidence presented by the Ministry of Finance, warning that although resources were assigned for May 2025, there is no guarantee that the availability of resources for the rest of the year (from May to December 2025) will be ensured.
For the Public Ministry, this situation could lead to a systemic crisis in the provision of public services, especially for strata 1, 2 and 3, requesting the Court to order the immediate payment of the recognized values. Also, he proposed that a payment schedule be defined for obligations not yet settled, in order to guarantee the flow of resources to marketing companies and ensure the sustainability of the system.
Finally, the control entity insisted that the claimed payments have already been officially recognized, so there is no legal or financial justification to continue postponing their disbursement.
